We Are Not Lawyers
We can tell you that section 52-136(2) caps a subcontractor's claim against a protected party, and what the statute says the cap is measured against. We cannot tell you whether you are a protected party, what your ceiling is, or what a particular recorded lien can reach.
Those are the questions that decide a disputed repair, and they need somebody with a licence and a duty to you. The framework is on our page covering protected party status and the cap.
Why Describe the Statute at All Then?
We Are Not Public Adjusters
We do not represent you on your insurance claim, we do not negotiate with your insurer, and we do not take an interest in the proceeds unless a contract says who keeps them.
Where a claim looks under-settled to us we will say so and suggest you get somebody qualified to look at it. That advice regularly makes your alternative to selling better, which is the test of whether we mean it.
We Are Not Contractors
We do not produce repair estimates for you and you should not treat our numbers as one. What we calculate is our own cost to do the work, which includes our margin and our risk and is therefore not the figure you would pay.
So How Do I Find out What the Repair Really Costs?
We Are Not Brokers
We are not licensed to market property on your behalf and we do not. Marketing property for others in Nebraska requires a real estate licence and the state lookup is free.
What we will tell you is when a listing would beat us, which across west Omaha and much of the Sarpy County ring is often.
What That Leaves Us Actually Doing
Buying whole properties as principal, in our own entity, with our own funds, taking title. We do not assign contracts.
Searching the public record. What is recorded against the property at the register of deeds, and we tell you what we find whether or not you sell to us.
Producing a written figure with finished value, cost of the work, carrying cost and margin each on their own line.
Saying when we are wrong for the file, which on roughly half of what we look at is the answer.
Where Our Interests and Yours Diverge
We are the buyer. We benefit if you accept less and decide sooner, and everything above is still true.
An unresolved lien reduces what any buyer will pay, including us, because somebody has to carry the uncertainty. So we have an interest in you not resolving it, and we would rather you did, because a clean title produces a higher price and a seller who is not aggrieved afterwards.
What We Buy
Fire-damaged residential property across Omaha, the surrounding counties and the wider region, in any condition, including where a repair began and stopped and where a claim was denied or there was no insurance at all. Beyond this region we would be the wrong buyer.
